TERMS AND CONDITIONS OF SALE FOR EXAM BOOKING, LEARNING MANUALS AND E-LEARNING FOR USERS -- -- --
1. Binding Agreement
1.1 A booking placed for any examination or learning materials facilities via this website constitutes a legally binding contract. In making the booking the applicant is deemed to have the requisite authority, which, in the case of an employee, shall include the power to bind his employer if paying using a company credit card. The applicant and their employer (if made using a company credit card) will be jointly and severally liable for the payment of the fee to the ABPI.
1.2 Under the terms of the contract ABPI is entitled to expect that you comply with ABPI requirements and regulations. You must read the Examination Regulations which are incorporated into this contract and ensure that you understand them fully. On the day of the exam you will also be asked to sign to confirm that you understand the exam regulations and instructions to candidates.
1.3 Please note that you will not be regarded as registered to sit the exam until all of the ABPI’s administrative requirements have been met, including the payment of exam fees. Up to the point where your exam registration is confirmed you are only registered provisionally.
1.4 ABPI owns the copyright in the E-learning modules available on the ABPI E-learning website, and the ABPI mark is a registered trade mark. On payment with completed registration the user is provided with access to these materials as an individual and may not further copy or distribute them for third parties whether or not for remuneration.
1.5 Each purchase of E-learning on the ABPI Exams website grants access for one individual linked to the email address provided when registering for the ABPI Exams website. Access to the E-learning website will be terminated once the named individual achieves the qualification they have registered for.
1.6 Exam candidates who have provided details of their training manager when registering for the ABPI Exam website may agree to the reporting systems built into the E-learning being used to monitor their use and performance when using the system. This access may be revoked by ABPI if requested by the candidate.
2. Fees
2.1 The fee for the exam booking or purchase of learning manuals or E-learning is set out in the appropriate stages of the booking process. The fee stated as payable is exclusive of Value Added Tax which shall be liable to be paid where appropriate in addition to the sum concerned. Payment to the Association of the British Pharmaceutical Industry may be effected on-line by credit card. Exam fees are valid for one calendar year after payment has been made.
2.2 ABPI must be in receipt of paid fees by the booking deadline stated for the exams to be booked. Payment must be made in pounds sterling. A registration, even when validated, does not constitute a valid booking until payment has been received by ABPI. ABPI reserves the right to refuse admission to individuals taking examinations if payment is not received on time. Confirmation of booking will be despatched upon receipt of paid fees. Any learning materials or passwords for online access to ABPI authorised E- learning facilities will be dispatched only on receipt of full payment.
2.3 The normal method for delivery of learning manuals is first class post. ABPI does not accept any liability for parcels that go missing, are damaged in transport or cannot be delivered. For international orders, please contact ABPI for a quote for delivery.
2.4 Access to ABPI E-learning will be provided within one working day of confirmed purchase via the ABPI Exam website, unless communicated otherwise.
3. Cancellation Policy
3.1 Any valid cancellation* must be in writing via the cancellation process on this website and cannot be requested by email.
*Cancellation means complete cancellation of an exam sitting which attracts a refund of exam fees in the circumstances set out below in 3.2. Deferment refers to your ability to amend an exam booking (which includes changing the date of the exam) at any point up to the final cut-off date for the exam that you have booked. You may not request deferment after the cut off date for the exam that you have booked.
3.2 Cancellations made within 14 days of the original booking date will receive a full refund of the fee in accordance with the Distance Selling Regulations.
3.3 Any cancellations made after 14 days of the original booking date will not attract a refund. It is not possible to defer an exam booking or otherwise transfer a fee paid for an exam booking to a different exam date under any circumstances after the relevant final cut-off date.
3.4 Circumstances relating to cancellation due to severe medical difficulties* should be submitted in writing via the website and evidence of an absence from work notification from a doctor or similar forwarded to the Head of Education and Academic Liaison as soon as reasonably possible and may at the discretion of the Head of Education and Academic Liaison attract a credit note for redemption against the next available sitting of the appropriate examination at the same location (or other location if sooner).
* Pressure of work, away at conferences, minor illness before the exam closing date etc are not extenuating circumstances. Please note that we will normally seek independent evidence to verify any cancellation request.
3.5 Any amendments (including deferment) to bookings may be made up to the booking deadline stated for the exam registered.
4. Liability
4.1 Where it is necessary for reasons beyond its reasonable control ABPI may change the location or dates of any publicised examination sitting.
4.2 If the examination sitting is required to be cancelled and is not replaced by a location within 25 miles or alternative sitting at the same location rescheduled within one month ABPI will make a full refund of the fee as a credit note for use against a future booking at your free choice.
4.3 Except for death or personal injury caused by negligence ABPI accepts no liability whatsoever for any direct, indirect, special or other consequential loss or damage of whatever kind resulting from cancellation of published examination sittings or from changes of any kind to the advertised programme of exams.
4.4 If any provision of this agreement shall be unlawful, void or for any reason unenforceable such provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
5. General Terms and Conditions
5.1 This contract for booking examination sittings and learning materials is subject to the General Terms and Conditions for use of this Website, which include the ABPI data privacy policy for all personal data received from individuals as part of the exam registration process.
5.2 Please note that misuse of your password or provision of false exam registration details by misrepresentation of your identity may result in you being refused access to the website or the examination or the result of any exam becoming invalidated and may result in a criminal charge.
5.3 ABPI will not pass on any information to your Employer or any other third party about your examination booking or result without your express consent.
5.4 By clicking on the “I agree” button to the terms and conditions of use of the booking facility you are expressly consenting to ABPI fairly dealing with information collected in the manner described above, in accordance with the Data Protection Act 1998.
6. Governing law
Any dispute arising out of this agreement shall be governed by English law and the English courts shall have jurisdiction over any such dispute.
